Please read this privacy policy carefully, as it contains essential information about how your personal data is processed and which cookies are used. By providing your personal data on the website and by providing personal data to the e-mail addresses stated on this website, as well as with the processing thereoff.

Article 1 – General

Mploy lawyers complies with the “Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data”, as well as the anti-spam provisions of Book XII of the Code of Economic Law regarding the “law of the electronic economy”.

By means of the present privacy policy, Mploy lawyers is also in compliance with the General Data Protection Regulation (in short “GDPR” - in full: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) and the national implementing legislation.

Mploy lawyers are also bound by professional secrecy, so that they will treat your information as strictly confidential.

Article 2 – Data subject

Mploy lawyers can collect and process the personal data of the following persons (non-exhaustive list):

  • (potential) clients and, in the case of legal persons, their employees;
  • visitors to our website and social media channels;
  • persons who subscribe to our newsletter;
  • participants in Spitsuur HR and other events organized by Mploy lawyers;
  • persons who spontaneously provide their contact details to Mploy lawyers;
  • persons who contact Mploy lawyers by phone or email;
  • applicants.

Article 3 – Personal data

Mploy lawyers collect the data below from you, in each case in proportion to and insofar as necessary to achieve the purposes of the processing included in Article 4.

3.1 Personal data you provide to us and/or personal data we process:

  • when visiting our website without registration: your IP address and any other electronic identification data (via cookies, see below);
  • upon registration: upon subscription to our newsletter: your email address, surname, first name;
  • when filling in the contact form on the website: name, telephone or mobile number, email address;
  • via cookies (see below);
  • as a client: the personal identification data of you and/or your company (i.e. name, address, telephone contact details, email address, VAT number); your capacity in relation to or your position within a company; the size of your company (with fewer or more than 50 employees); copy of your identity card; bank account number and holder of the bank account; financial transactions (such as payments); your invoicing data; your (legal) insurer;
  • for persons who spontaneously provide their contact details: the personal identification data of you and/or your company (i.e. name, address, telephone contact details, email address, VAT number); your capacity in relation to or your position within the company; the data that you provide yourself;

3.2 Mploy lawyers may collect your personal data in various ways:

  • by using cookies (see below);
  • during your registration and use of the website, our LinkedIn page and our other social media channels.

3.3 The website also uses cookies that collect some personal data. For the provisions on the use of cookies, please refer to Article 10.

Article 4 – Purposes of the processing and legal basis

4.1 General purposes:

The Company will only use the personal data collected from you for the following purposes:

  • the provision and improvement of the website and our social media channels and the inclusion of personal data in anonymous statistics, from which the identity of specific persons or companies cannot be derived, with the legal basis being the legitimate interests of Mploy lawyers to continuously improve its website and services. References shall only be used after prior written consent;
  • sending you invitations to seminars, with your explicit prior consent as the legal basis. You can unsubscribe via the appropriate link at the bottom of the newsletter or invitation or by letting us know at that you no longer wish to receive the newsletter;
  • the general management of client and supplier relations, the keeping of correct accounting and the management of the invoicing system, whereby data are processed to answer questions, handle disputes, defend against any claims and/or start procedures to collect fees still owed, with as legal basis the necessity for the proper execution of the agreements with clients and suppliers (including the pre-contractual phase), the legal obligation to keep correct accounting and the pursuit of legitimate interests for the proper execution of the (possibly future) agreements with clients and suppliers;
  • compliance with legal and ethical obligations, also in the context of the duty of identification and vigilance within the anti-money laundering legislation, on the legal basis of the various legal and ethical obligations vested in Mploy lawyers;
  • if a question is asked: contacting the asker with a view to providing an answer or managing the (potential) client relationship, with the legal basis of there being a need for the execution of the agreements with clients and suppliers (including the pre-contractual phase) and the pursuit of legitimate interests for the proper execution of the (possibly future) agreement;
  • recruitment and selection (e.g. assessing a CV and/or cover letter, conducting a job interview, conducting tests, etc.), with the legal basis of there being a need to, at the request of the data subject, take measures prior to the conclusion of a contract and the legitimate interests pursued by the controller (in particular the correct completion of a recruitment and selection process).

You are not obliged to disclose your personal data, but understand that the provision of certain services becomes impossible if you refuse the processing. Mploy lawyers invoke in such cases the legal basis of the need for the performance of the contract, or the need, at the request of the person concerned, to take measures before the conclusion of a contract.

4.2 Transfer to third parties:

In the event of a full or partial reorganisation or transfer of activities of Mploy lawyers, whereby it reorganises, transfers, ceases its business activities or if Mploy lawyers goes bankrupt, this may mean that your data is transferred to new entities or third parties through which the business activities of Mploy lawyers are fully or partially carried out.

Mploy will make reasonable efforts to inform you in advance of the fact that it discloses your data to the said third party, but you also acknowledge that this is not technically or commercially feasible under all circumstances.

Mploy lawyers will not sell, lease, distribute or otherwise make your personal data commercially available to third parties, except as described above or with your prior consent.

4.3 Legal requirements:

In rare cases, Mploy lawyers may need to disclose your personal information pursuant to a court order or to comply with other mandatory laws or regulations. Mploy lawyers will reasonably attempt to inform you of this in advance, unless this is subject to legal and ethical restrictions.

Article 5 – Duration of processing

We will retain and process the personal data for as long as necessary in view of the purposes of the processing (as set out in Article 4) and the contractual relationship between Mploy lawyers and you.

With a view to providing services to clients and in view of the legal obligations regarding combating money laundering and terrorism, personal data are stored for a period of at least 10 years from the end of the business relationship with the client or from the execution of the occasional transaction.

All personal data related to our newsletter will be retained as long as you are registered for our newsletter. You can unsubscribe via the appropriate link at the bottom of the newsletter or by letting us know at that you no longer wish to receive the newsletter. You will also no longer receive our newsletter if it appears that your e-mail address is no longer in use.

We store the personal data of applicants during the selection procedure and for one year after its termination, with a view to handling any complaints. We create a recruitment reserve for a period of two years after the end of the selection procedure. You are of course free to let us know at any time at that you no longer wish to be included in the recruitment reserve.

Article 6 – Your rights

6.1 Right of access, in accordance with Article 15 GDPR:

You have the right to consult your personal data that we process at any time, free of charge, as well as the use we make of your personal data and how and why we do this. You also have the right to receive a free copy of this personal data.

6.2 Right to Rectification, Erasure and Restriction pursuant to Sections 16 – 19 GDPR:

You are free to either or not disclose your personal information to Mploy lawyers. In addition, you always have the right to request us to correct, supplement or delete your personal data. You acknowledge that in case of refusal of communication or request for deletion of personal data, certain services will not be available.

You may also request the restriction of the processing of your personal data.

6.3 Right to object, in accordance with Article 21 GDPR:

You also have a right to object to the processing of your personal data for reasons relating to your specific situation.

In addition, you always have the right to object (free of charge) to the use of personal data for direct marketing purposes; in that case, you do not need to provide any reasons.

6.4 Right to data portability pursuant to Article 20 GDPR:

You have the right to obtain your personal data processed by us in a structured, commonly used and machine-readable form and/or to transfer them to other controllers.

6.5 Right to withdraw consent:

Insofar as the processing is based on your prior consent, you have the right to withdraw that consent.

6.6 Exercising your rights:

In principle, the exercise of your rights is free of charge. However, if we find that we receive unreasonable and/or repeated requests, Mploy attorneys reserve the right to charge a reasonable administrative cost.

Mploy lawyers always try to answer your questions and/or comply with your requests as quickly as possible and within a reasonable period of time.

6.7 Automatic decisions and profiling:

The processing of your personal data does not include profiling. Neither will we subject you to automated decisions.

6.8 Right to lodge a complaint:

Article 7 – Security and confidentiality

Mploy lawyers has developed specific security measures that are adapted at a technical and organisational level in order to avoid, as far as possible, the destruction, loss, forgery, alteration, unauthorised access or accidental disclosure of personal data to third parties, as well as any other unauthorised processing of these data.

Under no circumstances can Mploy lawyers be held liable for any direct or indirect damage arising from the improper or unlawful use of the personal data by a third party.

You must comply with the security requirements at all times, including by preventing any unauthorised access to your login and code. You are therefore solely responsible for the use made from the website of your computer, IP address and your identification data, as well as for the confidentiality thereof.

Article 8 – Third Party Access and Transfer

In order to process your personal data, we provide our employees and staff with access to your personal data.

The following persons (non-exhaustive list) can also gain access to personal data within the scope of their assignments:

  • service providers who process data for us (for example IT service providers, PR service providers, etc.);
  • professionals who advise us (for example accountants);
  • third parties that are involved in our services to clients (e.g. bailiffs, law firms and their clients, courts and their employees, witnesses, experts, social secretariats, (legal assistance) insurers);
  • public authorities (e.g. police services, judiciary, social security institutions, Flemish Bar Association, Bar Council).

We guarantee an equivalent level of protection by imposing contractual obligations on these employees and staff, which are similar to this privacy policy.

Subject to your prior express consent, your personal data will not be sold to third parties. The personal data are also not transferred to third countries and/or international organisations.
