Training: new dismissal scheme for civil servants

In collaboration with Larcier Intersentia, Mploy social law lawyers are organizing a training on Thursday, November 9 (2:00 PM - 5:00 PM) on the new decree of the Flemish Parliament that makes the rules regarding the termination of the employment contract applicable to a large number of provincial civil servants. and local authorities (effective: October 1, 2023).
Program
Clear explanation by Mr. Ludo Vermeulen , Mr. Dirk Heylen and Mr. Rob Valkeneers about the consequences of the new dismissal scheme for civil servants of provinces and local authorities. Some of the questions to which an answer is formulated:
- Which provisions of the law of 3 July 1978 on employment contracts now also apply to civil servants?
The decree did not include the provisions of the law on employment contracts regarding the suspension of the notice period: does the notice of a civil servant continue during the illness? - Are contractors and civil servants entitled to the same notice period or severance compensation?
The decree made no reference to the Unitary Statute Act: does this mean that civil servants who were employed before December 31, 2014 have a shorter notice period/lower notice compensation than employees with the same seniority? - Is the application of the dismissal rules otherwise the same between contractors and civil servants?
Can Saturday be regarded as a working day for the calculation of the "three-day period" in the event of dismissal for urgent reasons of a civil servant? Who is “the employer” who must be aware of the serious shortcoming of the civil servant that leads to dismissal for urgent reasons, and what is the starting time of the 'three-day period'? - Does the civil servant who receives a severance payment receive a civil servant's pension for the period covered by that compensation, or an employee's pension?
- Can the dismissed official start stamping?
