Training: new dismissal scheme for civil servants
In collaboration with Larcier Intersentia, Mploy advocaten sociaal recht is organizing a training session on Thursday, November 9 (2:00 PM - 5:00 PM) regarding the new decree of the Flemish Parliament that makes the rules concerning the termination of employment contracts applicable to a large number of civil servants of provinces and local authorities (effective date: October 1, 2023).
Program
A clear explanation by Mr. Ludo Vermeulen, Mr. Dirk Heylen , and Mr. Rob Valkeneers on the consequences of the new dismissal regulations for civil servants of provincial and local governments. Some of the questions answered include:
- Which provisions of the Law of 3 July 1978 concerning employment contracts now also apply to civil servants?
The provisions of the Law concerning employment contracts regarding the suspension of the notice period were not included in the decree: does the notice period for a civil servant then continue during illness? - Are contractors and civil servants entitled to the same notice period or severance pay?
The decree did not refer to the Unified Status Act: does this mean that civil servants who entered service before 31 December 2014 have a shorter notice period/lower severance pay than employees with the same seniority? - Is the application of the dismissal rules otherwise the same between contractors and civil servants?
Is Saturday to be considered a working day for the calculation of the “three-day period” in the case of dismissal for urgent reasons of a civil servant? Who is “the employer” who must be aware of the serious shortcoming of the civil servant leading to dismissal for urgent reasons, and what is the starting point of the 'three-day period' in that case? - Does a civil servant who receives severance pay receive a civil servant pension for the period covered by that payment, or an employee pension?
- Can the dismissed civil servant start stamping?
